  1. This Privacy Policy defines the rules for processing and protecting personal data provided by Users in connection with their use of services offered by the website https://shop.econsulting.co/

The Administrator of Personal Data of Users provided in connection with the use of eConsulting websites, in particular in connection with conducting recruitment processes, commercial activities, conducting training, sending marketing information (including newsletters), accepting registrations for conferences, events, and using other services included on the website is eConsulting Sp. z o.o. ul. Kochanowskiego 3, 05-802 Pruszków tel. 22 205 08 60. 

  3. In order to ensure the security of the data entrusted to us, we have developed internal procedures and recommendations aimed at preventing unauthorized access to data. We control their implementation and regularly verify their compliance with relevant legal acts - the Personal Data Protection Act, the Act on the provision of electronic services, as well as various executive acts and acts of community law.

  4. Personal data is processed based on the consent provided by the User and in cases where legal regulations authorize the Administrator to process personal data based on legal provisions or for the purpose of fulfilling the contract concluded between the parties.

  5. The Administrator processes voluntarily provided personal data by users only for the purpose of:

    • responding to inquiries from users sent using the contact form,
    • accepting orders using the online ordering system,
    • performing services provided by the Administrator based on Article 6(1)(b) of the GDPR,
    • marketing, including sending commercial information to the email address if the Customer has consented to it by selecting the appropriate box during the ordering process or submitting an inquiry through the contact form. Consent to the processing of data for marketing purposes and sending commercial information can be withdrawn by clicking the appropriate link in the received message or by sending such a notification to the Administrator's email address.

Cookies contain information necessary for the correct functioning of the website, especially those requiring authorization. PURPOSES OF PROCESSING PERSONAL DATA AND LEGAL BASIS FOR THEIR PROCESSING

 

  1. The Administrator processes Personal Data for the purpose of:

  2. Sending Users commercial and marketing information, including the eConsulting newsletter, to the email addresses provided by them, contingent upon the User's consent to receive such communications.

  3. In the case of sending newsletters, the legal basis is the User's consent to the processing of Personal Data (Article 6(1)(a) of the GDPR).

  4. Consent to sending Users unsolicited commercial information in accordance with Article 10 of the Act on the provision of electronic services is expressed by Users independently and separately.

  5. Sending Users, to the email addresses or phone numbers provided by them, responses to previously submitted inquiries sent through the contact form.

  6. In the case of contacting Users to provide responses, the legal basis for processing Personal Data is the consent of each User to the processing of personal data (Article 6(1)(a) of the GDPR).

  7. Reviewing job applications submitted by Users and potentially conducting a recruitment process by eConsulting, after obtaining prior consent from the User to process the data contained in the CV or form by eConsulting.

  8. In the case of processing Personal Data for the purpose of considering job applications, the legal basis is the consent of each User to the processing of personal data (Article 6(1)(a) of the GDPR).

  9. Organization and conduct of contests, conferences, and meetings by eConsulting.

  10. In the case of contests, the legal basis for processing Personal Data is the User's consent to the processing of personal data (Article 6(1)(a) of the GDPR).

  11. Organization and conduct of open and dedicated training sessions.

  12. In the case of training sessions, the legal basis for processing Personal Data is the contract for the provision of training services concluded with eConsulting by submitting the order form (Article 6(1)(a) of the GDPR).

 

USER RIGHTS

  1. According to Chapter III, Articles 15-21 of the GDPR, the User has the following rights regarding the processing of their Personal Data by eConsulting:

  3. Right to rectification of processed data,

  4. Right to erasure of data ("right to be forgotten"),

  5. Right to restriction of processing of data,

  6. Right to data portability,

  7. Right to object to further processing of data,

  8. The right not to be subject to decisions based solely on automated processing, including profiling.

  9. Each of the above rights is exercised at the request of the User. eConsulting considers the submitted request and provides a response within 1 month from the date of receipt of the request.

  10. As part of these rights, the User may withdraw consent to further processing of Personal Data for purposes that require consent at any time, with the understanding that withdrawal of consent does not affect the lawful use of personal data in actions taken based on consent before its withdrawal.

  11. As part of the right to access, the User is entitled to obtain the following information, in the form of a copy:

  13. Categories of Personal Data – what data we process, e.g., name, surname, phone number;

  14. Information about recipients or categories of recipients of data – to whom (person, company, institution) the data may be disclosed;

  15. Information about the right to request eConsulting to correct data, delete them, or limit their processing, as well as the right to object to certain data processing;

  16. Information about the possibility of filing a complaint with the Data Protection Authority;

  17. Information about the source of data if the data were not obtained directly from the User – indication of the person, company, or institution that provided the Personal Data;

  18. Regarding the application of profiling: the principles on which it is based, and the potential consequences for the User.

  19. eConsulting also informs that each subsequent copy of Personal Data is subject to a fee based on the costs incurred in creating the subsequent copy of Personal Data.

  20. eConsulting reserves the right to either not respond to the request or to respond at a later date than indicated above (up to two months) due to the number of inquiries or the complex nature of the submitted inquiry. By complex nature, we mean the necessity of compiling data from multiple IT systems or the need to consult with more than one person or department to obtain the requested information.

  21. In both of the above situations, eConsulting undertakes to inform the User of this fact, providing a justification each time.

 

PROCESSING OF PERSONAL DATA AND PROFILING

 

  1. At eConsulting, profiling takes place, understood as a form of automated processing of personal data, involving the use of certain data about the User. The acquired data include, among others, information from social media profiles, location data, and data provided by Users using forms on the eConsulting website.

  2. The analysis of User behavior while using the website is anonymous, and based on the acquired data, the User cannot be identified.

  3. Profiling enables us to:

  • Make a more informed and better matched selection of job offers, corresponding to the skills and experience of Users (in the case of job candidates at eConsulting),
  • Tailor commercial offers to the needs of the User,
  • Customize marketing and advertising materials to the interests and needs of Users.
  1. The User may object to profiling at any time, but this entails the impossibility of receiving marketing or commercial information or receiving new job offers tailored to the User's profile and professional experience.

 

LEAD FORENSICS

  1. eConsulting utilizes Lead Forensics to track code in order to identify companies visiting our websites based on their corporate IP addresses. This is not the same as using cookies. Under no circumstances will the data be used for personal identification of individual visitors.

  2. The Lead Forensics tool provides information on which companies have visited our website, the date and duration of the visit, and the pages visited.

 

SECURITY PRINCIPLES

  1. eConsulting has implemented appropriate security measures (organizational and technical) aimed at protecting Personal Data from loss, misuse, unauthorized processing, or modification. The Administrator undertakes to protect all information disclosed by Users in accordance with security standards and confidentiality principles. Access to User's Personal Data has been strictly restricted to prevent such information from falling into unauthorized hands. Access to Personal Data is limited to authorized eConsulting employees.

  2. eConsulting is authorized to disclose data to authorized entities based on applicable legal provisions.

 

USER DECLARATIONS

The User undertakes that: their use of the Services obtained from eConsulting will not violate any laws or the rights of third parties, including copyright, industrial property rights, trade secrets, or personal rights; they will not use the Services, Devices, or Products of third-party websites in a manner inconsistent with their intended use or exceeding the technical parameters specified in the Service Specification; they will not use the Services to disseminate content of a terrorist nature.

The User acknowledges that in situations where it is necessary to take appropriate preventive action, eConsulting may temporarily block access to the Services or modify the Service.

eConsulting counteracts the dissemination of terrorist content in accordance with the Regulation on preventing the dissemination of terrorist content online (EU 2021/784) and illegal content in accordance with the Regulation on the Single Market for Digital Services and amending Directive 2000/31/EC (Digital Services Act; EU 2022/2065).

eConsulting has designated an electronic contact point related to the Service for direct communication with the authorities of the Member States, the Commission, and the Council of Digital Services: gdpr@econsulting.co. The same contact point can be used by the User for direct and prompt communication with the Administrator. Communication may be conducted in Polish or English.

 

CONTACT FORM

In the event that a User submits an inquiry through the contact form, eConsulting will collect the data entered in the form, including the provided contact information, in order to respond to the inquiry and any further questions.

eConsulting will process any data entered into the contact form solely with the User's consent in accordance with Article 6(1)(a) of the GDPR. The User may withdraw their consent at any time. Data processed prior to receiving the User's request may still be processed lawfully.

 

POLICY CHANGE

Due to the development and progress of technology, as well as changing legal regulations, the rules set forth in this Privacy Policy may change. Users will be informed of any changes to these rules by posting the new content of this document on the website https://shop.econsulting.co/.
